TRAVELVAVA PRIVATE LIMITED, Hereinafter referred to as THE MEDI-TRAVEL FACILITATOR, is an Indian Company engaged in the business of providing inbound and outbound tour and travel services including Medical Tourism and is the referral agent of registered Hospitals all over India listed on the Website and or in the list of empanelled hospitals (collectively referred to as Panel Hospitals) thus referring the inbound tourists and/or residents interested/willing/desirous of getting medical treatment in India for the ailments suffered by them and acting as a Facilitator for sharing queries related to ailments and medical information between the Patients and Specialists/Doctors/Hospitals.

THE MEDI-TRAVEL FACILITATOR is also providing travel related services, such as, ticketing, tour operations, quality hotel accommodations, airport transfers, etc which the inbound tourists/foreign visitors may avail of on actual costs and as per its terms and conditions.

The Patient, who is desirous of receiving medical treatment during his/her stay in India, and intends to avail the services of THE MEDI-TRAVEL FACILITATOR, may do so on the terms and conditions stipulated herein below.

Terms and Conditions

1. By accessing or using the services of this Website and of THE MEDI-TRAVEL FACILITATOR, the User signifies his acceptance and acknowledgment to the terms and conditions set forth below as well as amended from time to time, including expressly, but not limited to the general principles of the website of its subsidiaries and affiliates. The Users are advised not to use the services of this Website if they do not agree to these terms and conditions.

2. This Website reserves the right to revise/modify these terms and conditions at any point of time without notice or reason, by updating this page, and the Users use of this Website after any such revision/modification, signifies Users acceptance to the revised/modified terms and conditions. Therefore the User is advised to check these terms and conditions periodically for any change(s).

3. The User is solely responsible for any activity that occurs under his screen name or by use of his Email account. The User hereby warrants that all information submitted by the User is true, current and complete. If information submitted by the User is found to be false, deceptive, incomplete or concealed deliberately, this Website reserves the right at its sole discretion to discontinue the services.

4. The User agrees to use the services provided by this Website, its affiliates, consultants and contracted companies, for lawful purposes only. The User agrees not to violate any laws, third party rights or our policies. International users agree to comply with all Local Laws regarding online conduct.

5. This Website reserves the right to refuse service to anyone for any reason at any time.

6. Services and obligations of THE MEDI-TRAVEL FACILITATOR

(a) Patient Referral and Payment Procedure : Upon receiving the query from Patients desirous of taking treatment in India alongwith their medical history/initial treatment or diagnostic reports in their home countries, THE MEDI-TRAVEL FACILITATOR shall forward the same and coordinate with the concerned Specialist Doctor/Hospital for advice/comments/suggestion, treatment procedure, costs, time line, etc and share the same with the patient within 10 (Ten) working days of the receipt of such query, provided it is complete with required documents.

(b) The receiving of reports/medical history/health details from the Patient in advance is a condition precedent in the cases where the Patient has already planned to receive treatment in India, except in emergency / Ambulatory cases.

(c) Assist the Patient to contact the concerned Hospital through our message box/ email regarding any clarification relating to his/her treatment in India.

(d) Refer the patients to the nearest Panel Hospital within India, in which State the patient is staying in India during his/her visit.

(e) Arrange for the desired quality hotel accommodations, conveyance and other facilities for the patient and his/her companions subject to advance payment against invoice raised by THE MEDI-TRAVEL FACILITATOR for such services rendered.

7. Obligations of the Patient

(a) The Patient shall contact the Hospital concerned through the message box/Email of THE MEDI-TRAVEL FACILITATOR with his/her reports/medical history papers/complete health details for any assistance prior to the commencement of the treatment.

(b) Upon admission and before the procedures, the Patient/companion shall sign the required authorisation letter for the procedure/surgery and also commitment letter favouring the Hospital (s) confirming that in the event of cross referral or additional diagnostic or treatment facility availed by the Patient, will pay the Hospital(s) the expenses thereof before leaving the said Hospital. This Website or THE MEDI-TRAVEL FACILITATOR shall have no role to play and the matter is within exclusive domain of the Patient and the concerned Hospital.

(c) The Patient/companion will pay the entire Cost(s) including advance cost of treatment as demanded by the Hospital against receipt of the same issued by the concerned Hospital before commencement of the treatment or as and when asked by the Hospital Authorities.

(d) The Patient will be liable to pay the escalated cost(s) - i.e the difference in the estimated cost and the actual cost of treatment as applicable at the time of undergoing the said treatment - necessitated by emerging medical conditions/additional treatment diagnosed before/during/after treatment/procedures, post treatment complications, cross-referrals as desired by him or if so advised by the Doctor in charge of the patient, whose decision shall be final and binding upon the patient.

(e) The Patient undertakes to clear all the pending bills towards cost of treatment carried out in India at the time of discharge from the Hospital.

(f) In the event, the Patient, after commencement of treatment, decline to continue the same for any reason whatsoever, he/she shall communicate the same in writing to the Hospital with an Email copy to THE MEDI-TRAVEL FACILITATOR and any payment made by the Patient to the said Hospital(s) for such treatment may be returned only after adjusting actual expenditure incurred up to the time of stopping such treatment which shall be within the exclusive domain of the concerned Hospital.

(g) The Patient/Companion clearly understands and acknowledges the role of THE MEDI-TRAVEL FACILITATOR as only a facilitator between the Patient and hospitals and that it has no liability in any manner whatsoever in the matter of the hospital processes, diagnosis, treatment, procedures, surgeries, post treatment, recovery or any issues arising out of the same and in regard to charges/costs for the same and the payments thereof which shall be entirely between the Patient and the hospital concerned. .

(h) The Patient/companion undertakes that he/she shall abide by all rules and regulations of the said Hospital(s) and also do not infringe any law(s) of India during the period of treatment.

(i) Charges to THE MEDI-TRAVEL FACILITATOR : In the event of the patient / companions are availing services from us for arranging accommodation (hotels/serviced apartments) for stay, air port transfers, local conveyance, ticketing, visa, insurance and any other related facilities/services, the patient/companion shall pay an advance amount of 75% of the total estimated cost to THE MEDI-TRAVEL FACILITATOR at the time of booking and remaining 25% at the time of his/her arrival in India against the invoice raised by THE MEDI-TRAVEL FACILITATOR towards such services rendered.

(j) In case the treatment of the Patient (foreign national) is likely to go beyond the stipulated period of his/her permitted stay in India, whereby making it necessary to get the extension of visa by the Patient, in that event all the initial formalities i.e. filing of application as well as other relevant tasks ancillary to that shall be solely done by and shall be the exclusive liability of the patient. However, THE MEDI-TRAVEL FACILITATOR may assist the patient or his/her companion in following the procedures and contacting the concerned Authorities, the costs of which shall be borne by the patient. The patient will pay to THE MEDI-TRAVEL FACILITATOR the service charge for such assistance and other related service rendered.

8. Disclaimer

(a) THE MEDI-TRAVEL FACILITATOR shall not be liable for inadequate/slow response to the treatment by the Patient, which would entail sending him/her back to their hometown/state/country.

(b) THE MEDI-TRAVEL FACILITATOR or Hospital(s) shall not be liable in case of an unfortunate death/ permanent/temporary disablement of the Patient during treatment / procedures/ surgery or any post treatment side effects and/or complications.

(c) In the unfortunate and unforeseen event of death of a patient, the Patient’s Companion/relative shall make required arrangements to remove and transfer the mortal remains to their home country at their own cost and risks. THE MEDI-TRAVEL FACILITATOR, shall assist in the best way possible to coordinate with the concerned authorities.

(d) THE MEDI-TRAVEL FACILITATOR is not a medical referral service and does not endorse, recommend or approve any health care provider. We do not provide medical services and will not discuss or advice you on the issues relating to medical treatment. We only facilitate contact with and provide information about health care providers for your desired medical treatment based upon their self related credentials without any verification of licenses, accreditations, certifications or other permits and approvals of the Panel Hospital(s).

(e) THE MEDI-TRAVEL FACILITATOR shall not be bound by any act or omission, which is done beyond the scope of this Terms and Conditions by the Patient or his/her accompaniment.

9. Termination

This terms and conditions shall become null and void in case of a breach of the terms or any violation of prevailing laws by the Patient without any notice.

10. Relationship/Status

The relationship/status that THE MEDI-TRAVEL FACILITATOR and Patient share with each other is only that of referring the patient to the Panel Hospital(s) along with their queries, medical history/complete health record of the Patient(s) who are desirous of getting health care/treatment in India and except this there is no other relation between both the parties. The use of any content obtained through this website does not establish any Physician-Patient relationship and any reliance/reference upon content obtained by you at or through this site is solely at your own risk.

11. Governing Law & Jurisdiction

The provisions of this terms and conditions shall be governed by and construed in accordance with Indian law. The rights and obligations of the Parties under, or any and all disputes arising out of these terms and conditions, shall be subject to the jurisdiction of the courts located in Cochin, India, which the User/Patient gives consent to.
